A New Mexico judge dismissed an indictment against actor and director Timothy Busfield in October 2026, after determining that procedural violations and errors had compromised the integrity of the grand jury proceedings, according to news reports. No announcement has been made by prosecutors on whether a fresh indictment will be sought.
According to an affidavit filed by the Albuquerque Police Department, Busfield — who held executive producer credits on 14 episodes of the Fox series The Cleaning Lady, directed six of those episodes, and appeared on screen in one episode in the role of an immigration officer — faces allegations of inappropriately touching a child actor during incidents said to have taken place between late 2022 and early 2024. New Mexico authorities filed a warrant for Busfield's arrest on January 9, 2026.
Busfield is said to have been serving as director on The Cleaning Lady — a Fox series that ran from 2022 to 2025 — when the incidents in question reportedly took place. Both the child making the accusation and his twin brother had roles as child performers on the programme.
The criminal complaint states that the child reported Busfield began making unwanted physical contact with him at age seven, with the alleged touching occurring on three or four separate occasions. A separate allegation against Busfield is based on a distinct count of five or six instances of physical contact with the child, who was eight years old at the time.
According to a sworn affidavit, the boy experienced considerable anxiety around Tim and felt a sense of relief whenever Tim was absent from the production. The document also noted that the child held back from disclosing the situation out of concern that Tim, in his capacity as director, would react negatively toward him. Separately, the boy's mother filed a report with Child Protective Services alleging the abuse took place across a period spanning late 2022 through the latter portion of 2024. A post-traumatic stress disorder diagnosis, along with anxiety, was recorded for the child in connection with the reported incidents.
Phone contact between Busfield and Officer Marvin Brown took place in November 2025, with that conversation documented within the affidavit. Responding to a question about whether he had made physical contact with the children on set, Busfield said it was highly probable that he had, and he characterised the working environment as playful in nature. Busfield added that no moment ever felt out of place and that any contact occurred with parents present, noting that he was routinely surrounded by other people.
Speaking with reporters, Busfield said the circumstances never struck him as out of the ordinary and that he had no memory of picking those boys up. He also recalled collecting the boy who had been trailing behind the group. Busfield told investigators that the children were never left unsupervised on set, with a teacher, welfare worker, or parent present at all times.
Court documents note that Busfield and his wife, Melissa Gilbert, gave the two boys Christmas presents and attended several social events with them — conduct that investigators described as consistent with a pattern designed to lower boundaries, distance victims from support, and normalize abusive behavior over time. Busfield turned himself in to authorities in New Mexico on January 13, 2026.
Prior to surrendering to authorities, Busfield addressed reporters gathered at his lawyer's office, identifying himself by name. He described driving approximately 2,000 miles to Albuquerque, said his purpose was to address what he characterised as falsehoods, and maintained that he had not harmed the children in question. "I plan to fight these charges with a strong legal team, and I expect to be cleared," Busfield said.
Court papers lodged on January 14, 2026, included a pretrial detention motion containing a disclosure that Colin Swift had approached law enforcement to report that Busfield had allegedly carried out sexual abuse against Swift's daughter in Sacramento, California, with the conduct said to have taken place some years prior. The filing states that during an audition at B Street Theatre with Busfield, a girl who was 16 at the time told investigators he kissed her and made unwanted physical contact.
According to reports, Busfield urged the family to keep the matter away from law enforcement on the condition that he pursue therapy — a course of action that Swift, who holds credentials as a therapist, indicated he viewed as appropriate under the circumstances. Defence counsel argued before the court that the allegations had never been put to any evidentiary test or formally verified, and that their origins lay some 25 years in the past.
Busfield was released from custody on January 20, 2026, while the defence maintained that the allegations involving women from roughly 25 years prior bore no apparent link to the separate claims concerning the young boys.
A New Mexico grand jury returned four counts of criminal sexual contact of a child against Busfield in February 2026, with the Bernalillo County District Attorney's office confirming the action through a written statement. District Attorney Bregman noted that Busfield retains the presumption of innocence, as applies to any defendant, unless and until a court establishes guilt through the formal legal process.
Court documents from New Mexico show that on February 21, 2026, Busfield entered not-guilty pleas on four counts of criminal sexual contact involving a minor, with the matter proceeding toward trial. A trial date of May 2027 had been placed on the court's calendar for the proceedings.
Busfield's attorneys filed a dismissal motion targeting the grand jury indictment in June 2026. A New Mexico judge determined in October 2026 that the indictment could not stand, pointing to a pattern in which witnesses, testimony, and documentary evidence were withheld from grand jurors even as those jurors made repeated requests for them — a set of procedural failures that the defence filing had placed at the centre of its argument that prosecutors handled the grand jury proceedings improperly. No announcement has come from prosecutors about whether a fresh indictment is being sought.
In an April 2026 interview aired on a television news programme, Melissa Gilbert called the arrest deeply distressing for her family and expressed full confidence that her husband would ultimately be cleared. Separately, a representative confirmed to another outlet that Busfield had been dropped by his talent agency, Innovative Artists, in connection with the case.
