IRDAI Plans Broader Insurance Reforms Covering Claims, Grievance Redressal and Products Following Distribution Overhaul

IRDAI Chairman Ajay Seth has confirmed that the regulator is developing reforms in claims management, grievance redressal, and insurance products, scheduled for release in the next financial year. The recently published distribution reform consultation paper, which proposes lower expense limits, commission caps, and clawback mechanisms, forms one component of a broader regulatory overhaul. Implementation of the distribution reforms is targeted for either January 1 or April 1, 2027, pending industry consultation and final regulation issuance.

Following the publication of a draft on distribution reforms, insurance regulator chairman Ajay Seth announced that proposals covering claims management, grievance redressal, and product-related changes are under development and expected to be released in the coming financial year. According to Seth, the proposed distribution reforms — including revised Expense of Management framework limits for insurers — are anticipated to take effect on either January 1 or April 1, 2027, following consultations with the industry. According to Seth, distribution reforms represent just one element within IRDAI's wider agenda of regulatory change. The watchdog body intends to introduce reforms covering complaint handling, dispute resolution, and product standards in the upcoming fiscal year. The aim is to enhance confidence in the insurance industry and advance the progress established by prior distribution reforms, with the spokesperson noting that the new measures would extend that earlier work. On Wednesday, the Insurance Regulatory and Development Authority of India (IRDAI) released a two-part consultation paper titled 'Recaliberating economics of insurance distribution', putting forward a comprehensive restructuring of how insurance distribution operates financially, encompassing reduced expense thresholds for insurers, commission limits tied to product categories for distributors, enhanced transparency around distributor earnings, and a mechanism to recover payments in instances of mis-selling. Stakeholders are invited to submit their feedback while the review period remains open. Seth stated that the goal is to build a streamlined insurance sector capable of serving the demands of India's expanding economy. Seth anticipated that insurers would transfer the financial benefits of reduced commission structures directly to their customers, adding that the proposed distribution reforms were designed to deliver tangible advantages to the general public and policyholders. Higher returns are one potential objective for those holding a life insurance savings product. Within the non-life insurance sector, this development is anticipated to improve loss ratios. Seth noted that the consultation paper was still in early stages, and added that cost savings ought to be reflected in reduced premiums or a slower rate of premium growth, with savings products also delivering improved returns for consumers. Draft regulations will subsequently need to be prepared and opened to public consultation before the final version can take effect. Among the options under consideration are start dates of either 1 January 2027 or 1 April 2027 for the framework's introduction.
