UN Experts Warn US Deportation Policy Triggers Cascade of Human Rights Violations

More than 20 independent UN experts have formally warned that US deportation agreements with over 35 countries are breaching international human rights law, putting tens of thousands of third-country nationals at risk of torture, trafficking, arbitrary detention, and other abuses. The experts called on all involved states to immediately halt the arrangements.

On Monday, a group of independent UN specialists stated that relocating people in large numbers to countries with which they have no prior ties heightens the risk of torture, ill-treatment, and enforced disappearance. UN human rights specialists said on Monday that deportation operations conducted by the United States across multiple nations are producing a cascading series of rights concerns, raising the prospect of abuses that include torture, forced labour, and trafficking. Specialists raised concerns that the arrangements could leave migrants exposed to a range of human rights abuses — among them arbitrary detention, forced labour, and trafficking — with children, women, persons with disabilities, survivors of trafficking, LGBT individuals, human rights defenders, stateless persons, and other particularly vulnerable populations bearing the greatest risk, including the possibility of loss of life for those in the most precarious situations, noting that formal notification had been delivered to all relevant governments, the United States among them. The organisation observed that many receiving countries lacked the capacity to handle asylum procedures, run appropriate detention centres, or provide sufficient healthcare and resettlement assistance, and further noted that a number of those countries were themselves affected by armed conflict, with their own populations facing displacement, food shortages and entrenched poverty, before urging all parties to halt such arrangements without delay, while also emphasising that joint participation in an agreement does not diminish individual legal responsibility, given that a country knowingly enabling another country's violation of non-refoulement or related human rights obligations may carry its own exposure under international law.
