At the close of its opening two-week argument session of the term, the Supreme Court took on a case tied to the Department of Government Efficiency, handed down an emergency ruling that favoured one party in pending midterm-related litigation, and moved forward a proceeding connected to John Eastman's bar membership dispute.
A petition-related entry tied to DOGE appeared on the order list released that Tuesday. Among the cases accepted by the justices this term, one involves a records request filed by a transparency group targeting the Department of Government Efficiency — a body linked to Elon Musk — with the administration having asked the court to intervene on its behalf. During an earlier phase of litigation over DOGE, justices holding seats filled by Republican administrations voted to restrict the scope of discovery that lower courts had been permitting into the cost-cutting programme.
The administration brought its confidentiality position back before the court, seeking a ruling in its favour.
Among the pairings that appeared on the order list, Justices Sonia Sotomayor and Neil Gorsuch were aligned on the same matter. On prior occasions, the two coordinated their efforts to raise objections about what they described as government overreach, at times when others among their colleagues chose not to speak up.
On Tuesday, a judge appointed by President Obama issued a written statement describing the prosecution of Jesus Herrera-Salazar on two separate charges as a contradiction of constitutional principles. A prior conviction for re-entering the country after deportation had placed him under supervised release, with the condition that he remain in Oklahoma. Adhering to that order placed him in the position of facing a new charge rooted in the act of remaining within the territory he had been directed not to exit.
In the opinion Sotomayor authored alongside the justice appointed by President Trump, the court called on future tribunals to give the Double Jeopardy Clause its full constitutional weight rather than allow the kind of procedural gap that arose in the case before them. On a separate matter involving political advertising rates, Sotomayor and Gorsuch reached opposing conclusions, with the outcome favouring Republican interests ahead of the midterm elections.
Justices Sotomayor and Jackson each placed their disagreement with Wednesday's ruling in favour of the Federal Communications Commission on the record, coming roughly a month after a separate matter in which Jackson had stood alone in opposition to a Republican-backed outcome. Faced with a petition from Democrats disputing how the FCC interprets advertising-rate law, the agency had been directed by a lower court to issue a formal ruling on the matter. A stay of the lower court's decision was granted by the Supreme Court's majority.
Senator Jon Ossoff and other Democratic candidates characterised the agency directive as unlawful and argued that procedural delays were being used to prevent courts from reviewing it before any ruling could take effect.
Separately, a ruling came down in Eastman's ongoing effort to retain his law licence after California authorities revoked it over conduct tied to his representation of former President Trump and the 2020 presidential campaign. Eastman, whose petition drew support from an array of conservative groups, told the court that the disbarment process posed a threat to First Amendment protections and stood to discourage attorneys from providing clients with thorough legal representation. The court ordered the state bar on Thursday to submit a response to the filing.
Whether that single request will translate into the four votes needed for the court to take up the case — and how a majority might ultimately decide it — remains an open question. Whether Justice Thomas is participating in the present matter also remains an open question, compounded by the fact that he stepped away from a prior Eastman-related proceeding without offering any explanation. The outcome for Eastman's application may shift depending on that question.
How Eastman's bar dispute fits alongside the DOGE discovery matter and other pending appeals this term is expected to take shape as the year progresses. No oral arguments are scheduled before the court reconvenes for its November sitting. Routine business will continue moving through the judiciary in the meantime, with a fresh order list set to arrive Monday morning alongside any unscheduled emergency rulings the justices may issue.
Two matters open to court action at any point include a government effort to put its restrictions on gender-affirming healthcare for incarcerated federal patients into effect, alongside a petition filed by a high school wrestler and her mother asking that she be shielded by injunction from competing against transgender girls during the coming season.
