Supreme Court Rules Private Citizens Can File Complaints Against Elected Representatives for False Election Affidavits
India's Supreme Court has ruled that private citizens can file criminal complaints against elected representatives who provide false information or conceal material facts in election affidavits. The bench of Justice Dipankar Datta and Justice Sheel Nagu clarified that Section 195 of the CrPC does not bar such complaints under Section 125-A of the Representation of the People Act. The ruling arose from an appeal by Rajkumar Madki against a Karnataka High Court decision that had quashed his complaint against a sitting MLA over alleged false residential address declarations in the 2023 Assembly election.
